Motion to Suppress leads to Dismissal

October 2023

I had a client who was charged with Possession of a Controlled Substance with Intent to Deliver, Penalty Group 1, 400 or more grams. I believed there was a problem with the legality of the stop and probable cause to search his vehicle. I set the case for a motion to suppress and after hearing the evidence the judge ruled in my client's favor and held the evidence was inadmissible. Instead of facing a potential sentence of 10 years to life, my client's charges were dismissed.
